What Is Family Law?

Family law is a branch of civil law that governs all legal relationships concerning the establishment, continuation, and dissolution of marriage. As this area directly affects individuals’ personal lives, it requires specialized legal expertise and a particularly sensitive approach.

At Unilaw, we provide comprehensive legal advisory and litigation representation services in the following areas:

  • Divorce proceedings (uncontested and contested)
  • Child custody and arrangements for personal contact
  • Alimony claims (interim, spousal maintenance, and child support)
  • Liquidation of matrimonial property regimes and division of assets
  • Domestic violence and protective measures
  • Prenuptial agreements and matrimonial property agreements

When considering the scope of legal practice, it is important to recognize the central role family law plays in protecting both individual rights and social order.

What Is Inheritance Law?

Inheritance law is the branch of law that governs how a person’s estate is transferred to beneficiaries and how inheritance shares are determined following their death. These proceedings are conducted in accordance with the principles established under the Turkish Civil Code and require technical legal knowledge and careful guidance.

Our key areas of service include:

  • Preparation and annulment of wills
  • Renunciation of inheritance
  • Reduction claims (actions concerning infringement of reserved shares)
  • Distribution of inheritance and dissolution of co-ownership
  • Obtaining certificates of inheritance
  • Interim measures and protective orders concerning estate assets
  • Transfer of an estate to the state (where there are no eligible heirs)

We advise our clients on frequently encountered questions, such as who the legal heirs are, how an estate is distributed, and how inheritance shares are determined. By clarifying their legal rights and obligations at every stage, we ensure that the process is managed effectively.

How Is an Estate Distributed?

Inheritance distribution is carried out among statutory and testamentary heirs in accordance with the Turkish Civil Code. Distribution may take place through an agreement between the heirs or, in the event of a dispute, through court proceedings.

In this process, we provide comprehensive legal support in the following matters:

  • Filing inheritance distribution lawsuits
  • Conducting settlement negotiations between co-heirs
  • Managing estate identification and valuation procedures
  • Handling dissolution of co-ownership (izale-i şuyu) proceedings

We also provide detailed information and strategic legal advice on technical matters such as inheritance rights, the conditions for obtaining interim measures over estate assets, the meaning of inheritance shares, the distribution of assets among heirs, and the determination of individual inheritance entitlements. Our aim is to prevent the loss of legal rights throughout the process.

Family Inheritance and Legal Protection

Family inheritance encompasses not only financial assets but also cultural and intangible values passed down from one generation to the next. In this context, protecting personal rights, safeguarding family members, and ensuring the fair distribution of inheritance are of great importance. At Unilaw, we assess matters by considering the interconnected principles of personal rights, financial law, and inheritance law, providing our clients with comprehensive legal solutions.

Our Sensitive Approach to Complex Legal Matters

Family and inheritance law requires not only a thorough understanding of legislation but also a high degree of empathy, psychological awareness, and meticulous protection of personal data. At Unilaw, we recognize the sensitive nature of these matters. We approach every case as a significant turning point in our clients’ lives and manage proceedings in accordance with ethical principles, respect for privacy, and professional responsibility.

Our goal is not merely to achieve a legal outcome but also to help our clients establish a secure and sustainable path forward.

At Unilaw Law Firm, we remain committed to protecting the rights and interests that matter most to individuals and families. Please contact us for professional legal support, to discuss your questions, or to benefit from our legal advisory services.

Frequently Asked Questions

Yes. A matrimonial property agreement can be executed before or during marriage in the form of an official deed or an agreement certified by a notary public. Through this agreement, spouses may choose a matrimonial property regime other than the statutory regime of participation in acquired property, such as separation of property, shared separation of property, or community of property.

Child custody is determined based on the best interests of the child. The judge evaluates the child’s age, physical and emotional needs, the living conditions of each parent, and their ability to provide proper care. The parties’ financial circumstances, social environment, and relationship with the child are also taken into consideration.

A reduction action is a legal action seeking the annulment or adjustment of dispositions made by a deceased person that infringe upon the reserved inheritance shares of protected heirs. Such actions may be filed by heirs entitled to reserved shares, including children, the surviving spouse, and parents. The limitation period is one year from the date the claimant becomes aware of the opening of the inheritance and the relevant disposition, and in any event, ten years.

Yes. An adopted person has the same legal inheritance rights as a biological child in relation to the adoptive parent. However, the adopted person does not acquire inheritance rights in relation to the adoptive parent’s relatives. Likewise, the legal inheritance relationship between the adopted person and their biological family remains intact.

A property division lawsuit may be filed together with divorce proceedings or after the divorce decree becomes final. However, even if no lawsuit has been filed, this right must be exercised within 10 years following the termination of the matrimonial property regime. Otherwise, the claim may become time-barred.

The annulment of a will may be requested through court proceedings on grounds that the testator’s intention was invalid, the will contains unlawful provisions, or it was not executed in accordance with the required legal formalities. An action for annulment may be filed by interested parties who become aware that the will has been opened. The limitation period is one year from the date of discovery and, at most, ten years from the date the will was executed.

A renunciation of inheritance agreement is executed in the legally prescribed official form before a notary public, between the deceased (or prospective testator) and the prospective heir. Through this agreement, the heir waives their future inheritance rights. Renunciation may be made with or without consideration, depending on the agreement between the parties.

First, a certificate of inheritance must be obtained. Subsequently, the inheritance and transfer tax declaration must be submitted and the applicable tax paid. The heirs can then apply to the Land Registry Office to complete the registration process. The transfer of title cannot be completed without the consent of all heirs.
